Welcome to Guessling. These Terms of Service ("Terms") are a legal agreement between you and Guessling ("Guessling," "we," "us," or "our") governing your access to and use of the Guessling website, guessing-game platform, and related services (collectively, the "Service").
By creating a game, submitting a guess, or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
Guessling is a platform for hosting baby-shower-style guessing games. A registered "Host" creates a game, invites guests to submit guesses about a baby's expected details (such as date of birth, weight, length, or name) through a shareable link or QR code, and can later reveal the actual details to generate a leaderboard. Guest participation does not require an account.
You must be at least 18 years old to create a Host account. There is no minimum age to submit a guess as a guest, but if you are under 18, you should have a parent or guardian's permission to use the Service. We do not knowingly collect personal information from children under 13 in a manner that would trigger obligations under the Children's Online Privacy Protection Act ("COPPA"); see our Privacy Policy for details.
3.1 Passwordless sign-in. Host accounts use email-based "magic link" sign-in. We do not store passwords. Keep your email account secure — anyone with access to it can sign in as you.
3.2 Accuracy. You agree to provide a working email address and to keep it current.
3.3 One person per account. You are responsible for all activity that occurs on games you create, whether or not you personally performed it.
3.4 Termination by you. You may stop using the Service at any time. You may request deletion of your account and associated games by emailing support@guessling.com.
3.5 Termination or suspension by us. We may suspend or terminate your access to the Service, including blacklisting an account, if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created risk or legal exposure for us or other users. Where practical, we will attempt to notify you.
4.1 Guests do not need an account to submit a guess or view a leaderboard. A guest's guess is tied to the link or QR code used to access the game, not to a verified identity.
4.2 Hosts, not Guessling, choose what information to request from guests (e.g., name, guessed date, guessed weight) via the fields they enable. Guessling does not verify the accuracy of any guess or any Host-configured field.
As a Host, you are solely responsible for:
5.1 The accuracy of the "actual answers" you enter at reveal time, and for any consequences of entering, editing, or re-revealing them.
5.2 Any content you upload, including background photos, and confirming you have the right to upload and display it. Uploaded images may not contain content that is illegal, infringing, sexually explicit, or that depicts a minor in an inappropriate way.
5.3 Sharing play and dashboard links responsibly. Dashboard links grant management access to your game; treat them like a password.
5.4 Compliance with applicable law in how you collect and use guest information (for example, if you photograph guests or otherwise gather information beyond what Guessling's guess form collects, outside of the Service itself).
5.5 Obtaining consent from guests, where required by law, before displaying their name or guesses publicly on a leaderboard.
6.1 What you're paying for. Some games are subject to a free-guess limit set platform-wide by Guessling. A Host may make a one-time payment to remove that limit across every game their account owns, present and future, as described on the Guessling home page at the time of purchase.
6.2 Processor. Payments are processed by Stripe, Inc. Guessling does not receive or store your full payment card number. Your payment is subject to Stripe's own terms.
6.3 No subscriptions. As currently offered, the unlock payment is a single, one-time charge — not a recurring subscription. If this changes, we will update this section and provide notice before the change takes effect for existing accounts.
6.4 Refunds. Payments are generally final. We may, at our discretion, issue a refund — for example, if a payment did not unlock your account due to a technical error, or as required by law. Contact support@guessling.com for refund requests.
6.5 Pricing changes. The free-guess limit and unlock price may change over time and apply platform-wide. A change in pricing after you've already unlocked your account does not affect games you've already unlocked.
6.6 Taxes. Applicable sales, use, or similar taxes may be added to the price shown at checkout, consistent with the rules of the jurisdiction the payment is sourced to.
7.1 Your content. You retain ownership of the content you submit (game names, guesses, uploaded photos, revealed answers). By submitting content, you grant Guessling a non-exclusive, worldwide, royalty-free license to host, display, transmit, and reproduce that content solely as necessary to operate the Service (for example, showing it on the dashboard and public leaderboard).
7.2 Our content. The Guessling name, logo, design, and underlying software are owned by Guessling or its licensors and are not licensed to you except as needed to use the Service as intended.
7.3 Removal. We may remove content that violates these Terms or applicable law, including in response to a valid takedown notice.
You agree not to:
9.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 We do not guarantee the Service will be uninterrupted, error-free, or available at any given time, including during a live event such as a baby shower. We recommend Hosts have a backup plan (e.g., manually tracking guesses) for events where connectivity is critical.
9.3 We are not responsible for the accuracy of any guess, any Host-entered "actual answer," or any dispute between a Host and their guests about game outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
10.1 GUESSLING AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
10.2 GUESSLING'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID GUESSLING IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY DOLLARS ($50).
10.3 Nothing in these Terms limits liability where applicable law does not permit such a limitation (for example, liability for gross negligence or willful misconduct).
You agree to indemnify and hold Guessling harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your content, or your use of the Service, except to the extent caused by Guessling's own violation of law or these Terms.
12.1 Informal resolution first. Before filing any claim, you agree to contact support@guessling.com and give us 30 days to try to resolve the dispute informally.
12.2 Venue. Any dispute not resolved informally will be brought in a court of competent jurisdiction, and each party consents to personal jurisdiction in the courts where the other party properly brings suit consistent with applicable law.
We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and, where practical, provide notice (such as a banner on the site or an email to Hosts). Continued use of the Service after changes take effect constitutes acceptance.
14.1 Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Guessling regarding the Service.
14.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
14.3 No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
14.4 Assignment. You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets (including a conversion from sole proprietorship to LLC).
